In November, Coloradans voted to add Amendment 41-Ethics in Government to the state constitution. Amendment 41 prohibits gifts of more than $50 to a government employee or independent contractor. Questions arose regarding whether Amendment 41 prohibits awarding scholarships to government employees, their children, or spouses.
The Denver Foundation consulted with legal counsel and took formal action by filing a lawsuit requesting that it not be considered a violation for persons outlined in the Amendment to accept a scholarship from The Denver Foundation. We are happy to report that, on Tuesday, April 10th, the Judge signed our proposed Amendment 41 Order. This Order protects The Denver Foundation and its scholarship recipients from the effects of Amendment 41, at this time and for the foreseeable future. All students who are selected to receive a scholarship can accept their award regardless of where they or their parents are employed. |
